DPIIT Notifies Transition Facilitation (Quality Control) Order

The Ministry of Commerce and Industry, through the Department for Promotion of Industry and Internal Trade (DPIIT), issued the Transition Facilitation (Quality Control) Order, 2026, introducing a risk-based compliance framework that offers greater flexibility. The Order issued on 25th June 2026 under S.O. 3417(E) allows domestic manufacturers to obtain a BIS licence under Scheme-II for supplying products to companies that receive DPIIT permission under the Scheme, provided the products continue to meet applicable Indian Standards.

 

This Order has been issued under the Bureau of Indian Standards (BIS) Act, 2016, to facilitate compliance with selected Quality Control Orders (QCOs) and to ensure that products continue to meet the applicable Indian Standards. Although this Order provides a facilitation mechanism, the products must still: 

  • Conform to the applicable Indian Standards.
  • Carry the BIS Standard Mark under a valid BIS licence.
  • Continue to comply with the relevant Quality Control Order.

 

Purpose of the Transition Facilitation Order 

According to the official notification, the Order has been issued in the public interest under the Bureau of Indian Standards Act, 2016.
It provides a framework for:

  • Helping businesses meet the requirements of specified Quality Control Orders.
  • Allowing eligible companies to obtain approval from DPIIT.
  • Making sure they continue to follow the relevant Indian Standards.
  • Allowing BIS to monitor the market to check ongoing compliance.

 

Which Products are Covered Under This Order?

All these ten products need to undergo the complete process of Scheme I of BIS, which includes factory inspection and ISI marking. But under this Order, the manufacturers of these products can apply for Scheme II, which does not involve any factory inspection and is more of a self-declaration, to supply their products to only one single approved buyer.

Who Can Apply for Permission Under the Order and Their Responsibilities?

The Standard Mark may only be used where a licence issued by BIS under Scheme II of Schedule II of the BIS (Conformity Assessment) Regulations, 2018, has been obtained and is available only for use by a manufacturer when supplying goods to a person authorised by DPIIT.

A person who receives permission under this Order must ensure that:

  • The supplied products comply with the applicable Indian Standards.
  • The products continue to meet the requirements set out in the relevant Quality Control Order.
  • A company incorporated under the Companies Act, 2013, is subject to risk assessment by the Implementation Committee

 

Market Surveillance and Implementation Committee Under the Order

As per the Transition Facilitation (Quality Control) Order, 2026, the Central Government has constituted an Implementation Committee to assess applications submitted under this order. The Order provides that the BIS, in consultation with DPIIT, may directly or through notified agencies, conduct market surveillance and verify that products continue to conform to the applicable Indian Standards.

  • Additional Secretary or Joint Secretary (In-charge of Technical Regulations), Department for Promotion of Industry and Internal Trade (DPIIT).
  • Additional Secretary or Joint Secretary, Department for Promotion of Industry and Internal Trade (DPIIT) of the concerned product.
  • Joint Secretary, Department of Consumer Affairs.
  • Joint Secretary, Department of Commerce.
  • Representative of the Directorate General of Foreign Trade (DGFT), not below the rank of Joint Secretary.
  • Representative of the Bureau of Indian Standards (BIS), not below the rank of Joint Secretary.
  • Director or Deputy Secretary or equivalent (in charge of Technical Regulations), Department for Promotion of Industry and Internal Trade (DPIIT).
  • Any other representative, not below the rank of Deputy Secretary or Director, from any Ministry, Department, or Organisation, as invited by the Chairperson.

 

How Does the Implementation Committee Assess an Applicant?

The Committee may assess an applicant based on:

  • The Assessment will be conducted based on the technical capability of the Company
  • The company's demonstrated experience will be evaluated
  • How the company will ensure quality assurance throughout its supply chain, including control over design and manufacturing.
  • Assessment of the company's history of conduct and compliance integrity
  • Check whether the company has complied with the relevant Quality Control Order continuously for three years without default.
  • Evaluation of the company's commitment to establish supply chain capabilities in India by promoting Technological adoption, technological advancement, design capabilities, and research and development
  • The Committee may also consider any Other Relevant Factors.

The Implementation Committee may interact with the person by relying upon documents:

  • Interact with the applicant.
  • Review documents.
  • Examine declarations.
  • Consider certifications.
  • Verify undertakings.
  • Review independent assessments.
  • Consider any other material it considers appropriate.

 

Key Provisions of the Transition Facilitation (Quality Control) Order, 2026

Details

Suspension or Withdrawal of Permission

If the conditions are not followed, the government may suspend, modify, or withdraw the permission in case of misrepresentation or material failure of the product to conform to the applicable Indian standards.  An opportunity to be heard will be provided before any action is taken.

Application Timeline

Applications for permission under this order will be accepted within 24 months from the date of commencement of the Order.

Application Guidelines

DPIIT issues guidelines covering the application process, required documents, entitlements, monitoring, and compliance requirements.

Validity of the Order

The Order will remain in force for five years from the date of its commencement unless extended by the Central Government through an Official Gazette notification.

After the Order Ends

Permissions granted before rescission will remain valid for their specified period, and existing rights, obligations, liabilities, investigations, and proceedings will continue to remain unaffected.



Interpretation of the Order

Any question regarding the interpretation of the Order shall be referred to the Department for Promotion of Industry and Internal Trade (DPIIT) for its decision.
