Order Issue Date: 13 Nov, 2025

The Ministry of Heavy Industries has provided a significant update related to the regulation of Machinery and Electrical Equipment in India. The Government published the Machinery and Electronic Safety (Omnibus Technical Regulation) Second Amendment Order, 2025, on 13th November 2025; this Order will affect several companies, importers, and manufacturers of regulated items.

The issuance of this amendment was made under the authority granted by Sections 16, 17, and 25 of the Bureau of Indian Standards (BIS) Act, 2016, and the amendment is intended to enhance public welfare, product safety, and quality, as well as regulatory clarity, with respect to machinery and electrical equipment.

What is the Omnibus Technical Regulation (OTR)?

The Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024, is a unified regulatory scheme developed by the Ministry of Commerce, Government of India, to facilitate compliance with basic safety, quality, and other requirements for electrical equipment and machinery sold or imported into India.

It establishes provisions related to BIS certification, compliance with Standards, and compliance with safety requirements, which must be complied with by the Manufacturer before it can place the products onto the Indian market. The original principal OTR was:

  • Notified as S.O. 3649 (E) dated 28th August 2024
  • Amended by S.O. 2579 (E) dated 12th June 2025

The new amendment for 2025 will be the second amendment to this OTR.

Key Update Introduced in the 2025 Second Amendment

The Second Amendment Order, 2025, is an amendment that primarily amends a dated implementation timeline stated in the original 2024 OTR.

What Has Been Amended?

The 2024 Order stated in Paragraph 1(2) for implementation date of;
After one year from the date of its publication in the Official Gazette was previously amended in the First Amendment on the 1st September 2026.

The Second Amendment Order, 2025, has now replaced the specific date with a more flexible clause. From such date as may be notified by the Central Government in the Official Gazette.

What Does This Imply?

  • There is currently no implementation date.
  • The Government will issue a separate notification in the Official Gazette establishing a new effective date of implementation.
  • This amendment gives industry further time and flexibility for preparation for compliance.

This amendment has been introduced to allow for a smoother transition for industry change and to give stakeholders more time to adapt to the regulatory change mandated under the Omnibus Technical Regulation framework.

Why Was This Amendment Issued?

The Government of India is consulting with BIS and has issued the updates, keeping in mind:

  • The scale and complexity of compliance required for machinery and electrical equipment
  • The need for businesses to have adequate preparation time
  • Ensuring public interest and safety while avoiding disruption to manufacturing or trade.
  • Allowing industry stakeholders to align their processes, testing, and certifications as per the new standards.

Who Will Be Affected by This Change?

This amendment impacts all machines and electrical equipment listed in the first Schedule of the principal Order:

  • Manufacturers of machinery and electrical equipment
  • Importers and foreign manufacturers seeking BIS approval
  • Dealers, distributors, and retailers of regulated products
  • Testing laboratories and conformity assessment bodies
  • Industrial buyers who rely on certified machinery
  • Until the Government issues a new effective date, businesses are not yet required to implement the OTR compliance, but are expected to stay prepared.

What Manufacturers & Importers Should Do Now?

Although the effective date is now indefinite, companies should now go through the following steps:

  • Stay Updated: You must track the future notifications from the Ministry of Heavy Industry, BIS, and the Official Gazette.
  • Collect Required Documents: Ensure that technical files, product manuals, and testing reports are ready for BIS Submission once the date is announced.
  • Conduct Pre-Compliance Check: Start evaluating the products against the Indian Standards (IS) under OTR (Omnibus Technical Regulation).
  • Engaging with Top BIS Consultant: A professional compliance consultant, such as ERCS Private Limited, can help to identify applicable standards, handle BIS certification, manage testing and documentation, and ensure full regulatory compliance before enforcement.

The Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Second Amendment Order, 2025, represents an important change to expand from a fixed time for implementation to a time to be notified later by the Government.
