EPR Registration India

Extended producer responsibility (EPR) registration is a requirement imposed by the Government of India on all businesses operating under the Waste Management Rules.  EPR registration provides an avenue through which PIBOs can support sustainable waste management.

In India, the Central Pollution Control Board (CPCB) administers EPR registration requirements through the implementation of the various Waste Management Rules issued by CPCB to protect the environment. The CPCB regulates the management of plastic waste, electronic waste, and battery waste through the Waste Management Rules, and EPR registration is required for businesses that manufacture, import, or receive regulated products.

This comprehensive guide explains what EPR Registration is, who requires EPR authorisation from CPCB, how EPR applies to plastic waste, e-waste, and battery waste, and the step-by-step process for obtaining EPR Registration in India. Whether you are a manufacturer, importer, or brand owner, complying with CPCB EPR guidelines is essential to avoid penalties, meet sustainability obligations, and operate legally in the Indian market.

Why EPR Registration is Mandatory in India for Sustainable Waste Management?

EPR Registration is mandatory for Producers, Importers, and Brand Owners (PIBOs) legally accountable for the full lifespan of their products (plastics, electronic waste, batteries, etc.). Compliance with EPR Registration is enforced by the Central Pollution Control Board (CPCB) in order to provide the PIBO access to the marketplace and to align India with the goals of Sustainable Development Globally.

By making EPR Registration mandatory, the CPCB aims to:

  • Encourage greater recycling and promote circular economy methodologies
  • Reduce environmental pollution and landfill waste
  • Establish a liability for businesses regarding the waste
  • Stimulate the design of sustainable products and packaging
  • Fulfil India's environmental and sustainable development objectives

Who is Eligible for EPR Registration in India?

EPR Registration in India is mandatory for businesses that introduce products or packaging into the Indian market and generate waste after end use. As per the guidelines issued by the Central Pollution Control Board (CPCB), the following entities are eligible and required to obtain EPR Registration:

1. Producers: Businesses that manufacture products or packaging covered under EPR regulations. Such as plastic packaging, electrical and electronic equipment (e-waste), and batteries must register under EPR and fulfil their waste collection and recycling obligations.

2. Importers: Any entity that imports plastic products, electronic goods, batteries, or packaged items into India is required to obtain EPR authorisation from CPCB, even if the products are manufactured outside India.

3. Brand Owners: Companies that sell products under their own brand name, whether manufactured in-house or through third-party manufacturers, are also required to obtain EPR Registration if their products generate regulated waste.

Entities Covered Under EPR Registration

  • Producers, Importers, and Brand Owners (PIBOs)
  • Businesses dealing in plastic waste, e-waste, and battery waste
  • Domestic manufacturers and foreign companies selling in India through importers

Types of EPR Registration: Plastic, E-Waste, Battery Waste & Non-Ferrous Metal

There are basically four main types of EPR registration in India, which we have covered in detail. Let’s review them: Plastic Waste, E-Waste, Battery Waste, and Non-Ferrous Metal registration under EPR.

EPR Registration for Plastic Waste:

This EPR registration ensures the correct way of collecting, recycling, and disposing of plastic waste in the manner stipulated in the Plastic Waste Management Rules.

EPR Registration for E-Waste:

The E-Waste EPR Registration will concentrate specifically on proper collection, environmentally friendly recycling, and conforming to the E-Waste Management Rules for recycling and channelisation of electronic waste.

EPR Registration for Battery Waste:

All businesses involved in portable, automobile (automotive), industrial batteries and EV batteries must obtain an EPR Registration for these batteries. This EPR Registration confirms that battery waste is being managed in accordance with Battery Waste Management Rules.

EPR Registration for Non-Ferrous Metal:

Businesses that manufacture or produce non-ferrous metal (i.e. aluminium, copper, zinc, lead and other metals) must obtain EPR Registration. The EPR Registration for Non-Ferrous Metals will help support sustainable metal recovery and recycling as prescribed by the CPCB.

Documents Required for EPR Registration in India

Below we have mentioned the list of documents required for EPR Certification for manufacturers and importers:

  • Certificate of Incorporation / Business Registration
  • Company PAN Card
  • GST Registration Certificate
  • Identity and address proof of the authorised signatory
  • List of products covered under EPR
  • Details of waste type (plastic waste, e-waste, battery waste, etc.)
  • Product specifications and HSN codes (if applicable)
  • Import Export Code (IEC) – for importers
  • Import invoices and Bill of Entry – for imported products
  • Manufacturing license or factory registration – for producers
  • Detailed EPR Action Plan
  • The estimated annual quantity of waste generation
  • Agreement or MoU with CPCB-authorised recycler or PRO
  • Consent to Establish / Consent to Operate or SPCB authorisation (if applicable)
  • Brand authorisation letter or trademark certificate – for brand owners
  • Annual sales data
  • Previous EPR compliance records (if any)

Step-by-Step EPR Registration Process for Manufacturers and Importers

The following steps, taken together, represent all battery, electrical equipment and other similar product manufacturers seeking EPR authorisation through the Central Pollution Control Board of India:

  • Develop an EPR Strategy: The manufacturer is required to develop an EPR strategy that describes how it will collect and recycle its products after their end-of-life stage.
  • Complete the Application: Complete the EPR authorisation application located on the Central Pollution Control Board's website according to the location of the manufacturer's manufacturing facility.
  • Attach Required Documents: The EPR authorisation application must be submitted along with additional documentation that the manufacturer must submit.
  • Submit Application: Depending on the location of the manufacturing facility, the manufacturer must submit both the EPR authorisation application and the complete set of supporting documents to the Central Pollution Control Board.
  • Wait for Approval: After confirming that the EPR authorisation application is complete, the Central Pollution Control Board will issue an EPR authorisation certificate to the manufacturer.

EPR Registration Penalties & Non-Compliance Risks

In India, if Manufacturers or Importers fail to obtain EPR registration for Non-ferrous metals, they must face legal, financial and practical issues. There is close monitoring of the EPR requirements by the CPCB through the Plastic Waste Management Rules, E-Waste Management Rules and Battery Waste Management Rules, which means compliance is critical for Producers, Importers and Brand Owners (PIBOs).

Failure to acquire EPR Registration or meet their assigned collection and recycling targets will likely result in the imposition of environmental compensation (EC) penalties by the CPCB against the business. The amount of these penalties is calculated based on the total amount of waste not managed in an environmentally appropriate manner and may be increased for subsequent violations.

How Long Does EPR Registration Take in India?

The timeline for EPR (Extended Producer Responsibility) registration in India includes a processing period of 15 to 30 working days for initial approval by the Central Pollution Control Board (CPCB) after submitting the required documents and payment of fees. It is important to note that specific regulations apply to Plastic Waste (Producers, Importers, and Brand Owners, or PIBOs) and Electronic Waste , which require separate attention.
