Withdraws Machinery and Electrical Equipment Safety (OTR) QCO

Under the recent Quality Control Order of Governmnet of India, the Ministry of Heavy Industries, on 14th January 2026, rescinded/cancelled the earlier notification of 28th August 2024, which was known as “the Safety of Machinery and Electrical Equipment (Omnibus Technical Regulation) Order 2024”.

 

This action has been undertaken by the Central Government based on its power under Section 16 of the Bureau of Indian Standards (BIS) Act, 2016, claiming that this action is in the public interest. This order is effective from today, which means that the 2024 Safety Order is no longer applicable from now on.

 

Why Did the Government Withdraw the Order?

According to the recent notification, the Government has rescinded the recent order to serve for the public interest. This withdrawal indicates that the Government may revisit the regulation later in a more structured or sector-specific manner. While the notification does not provide specific reasons for the decision, such actions are typically taken for the following reasons:

Background of the Omnibus Technical Regulation Order, 2024

The Government of India published the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order 2024 on 28th August 2024. Its goal is to establish a unified regulatory framework for multiple types of machinery and electrical equipment.

  • Increase the level of safety associated with machinery and electrical equipment that are used within India.
  • Ensure that all products that are manufactured and/or sold in India comply with relevant technical and safety standards; and

  • Bring Indian safety requirements in line with global standards for best practice.

 

What Does “Rescinded with Immediate Effect Order” Mean?

Under the recent Quality Control Order Update, the term “Rescinded” means that the order hasbeen cancelled or withdrawn completely: 

  • The Omnibus Technical Regulations Order, 2024, is no longer applicable
  • Businesses are not required to comply with this order from 14th January 202 onwards
  • Any enforcement action planned under this order is now invalid
  • However, the other applicable BIS Standards, IS certifications, and QCO remain in force

 

Who Is Impacted by This Regulatory Change?

All of the following entities will be greatly impacted by the removal of the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order:

  • Manufacturers of machinery and electrical products;
  • Importers and exporters;
  • Distributors and suppliers;
  • Compliance consultants and testing labs; and
  • Any business pursuing BIS Certification in relation to any of its products.

 

What Should Businesses Do After This Withdrawal?

Although this order has been rescinded, businesses can’t assume total freedom from regulation. To remain in compliance with existing BIS standards and BIS CRS Registration India requirements, as well as government regulations and rules applicable to their operations, the following steps should be taken by all companies:

  • Remain compliant with all currently established BIS CRS requirements;
  • Continue following all future Ministry of Heavy Industry and BIS communications regarding changes to BIS CRS License requirements;

  • Prepare themselves to deal with any potential changes to Safety Regulations in the future.
